In line with the principle of creating a good social environment for the healthy growth of minors, the “Woomi Minor Protection Measures” have been established.
Chapter Ⅰ General Provisions
Article 1 The full protection of minors is the core value of Woomi, the lifeline of enterprise development, and the highest priority of enterprise development.
Chapter Ⅱ Production Links
1. Article 2 All nicotine-containing electronic cigarette products of Woomi refer to the warnings on domestic cigarette packages, and print “This product contains nicotine, which is prohibited for minors” on the front of the outer package.
2. Article 3 Actively develop and produce lower nicotine content products and de-nicotine products.
1. Article 4 In accordance with national laws and regulations and the notices of the two ministries and commissions, online sales shall be stopped, and the promotion and marketing of electronic cigarette products shall not be carried out online.
2. Article 5 No new directly-operated stores and franchised stores will be added within 200 meters of primary and secondary schools; for the individual existing directly-operated stores and franchised stores that do not meet this requirement, the promise not to sell to minors should be strictly abided by, and gradually withdraw from the store.
3. Article 6 All offline direct-sale stores and franchise stores shall post the sign “Minors are prohibited from purchasing and using” in a prominent position.
4. Article 7 Distributors and agents are not allowed to distribute goods in stores around primary and secondary schools (for the specific scope of “surroundings”, please refer to the relevant regulations on the establishment of tobacco and alcohol shops in various places).
5. Article 8 “Prohibit the sale of electronic cigarettes to minors” and “prohibit the establishment of stores around primary and secondary schools” into the contract terms with dealers and franchisees. Once a violation is found, the responsibility for breach of contract will be investigated until the cooperation qualification is cancelled.
6. Article 9 In all sales terminals and offline activities, electronic cigarettes and related products are not sold to minors.
Chapter Ⅳ Brand Promotion Link
1. Article 10 In terms of brand communication, do not use any advertising slogans that induce minors to use, such as “popular, youthful” and so on.
2. Article 11 Strictly regulate the terms used in external promotion, and the prohibited words include but are not limited to: healthy, harmless; quitting smoking; safe, green; words that exaggerately describe the functions of electronic cigarettes, such as lung-clearing artifacts, energy bars, and beauty products; Cool, trendy, dazzling and other words that promote fashion; expressions that can be used anytime and anywhere; the use of words such as “0 tar” is based on the test results of national institutions.
3. Article 12 For offline promotion activities, it is necessary to prompt “Minors are not allowed to enter” in a prominent position, and arrange staff to conduct on-site supervision to prevent minors from entering the activity area.
Chapter Ⅴ Supervision and Inspection
1. Article 13 In order to strengthen management and strictly regulate offline sales behavior, the responsible persons of each region conduct regular inspections of dealers, agents and franchisees within their jurisdiction. The city manager shall not less than once a week; the person in charge of each province shall not be less than once a month; the person in charge of the region shall not be less than once a quarter; the person in charge of the company shall conduct unannounced inspections.
2. Article 14 Woomi direct-sale stores set up a team to set up a supervisory group, and conduct regular staff training. Direct-sale stores in all regions of the country conduct monthly self-inspection, and timely feedback the self-inspection to the leading group.
3. Article 15 From time to time, the staff of relevant institutions such as the local market supervision agency and the Tobacco Monopoly Bureau shall be invited to conduct joint inspections.
4. Article 16 All sectors of society are welcome to jointly supervise and establish a supervision and reporting hotline and e-mail. If Woomi direct-sale stores, distributors, agents, and franchisees are found to be selling e-cigarettes to minors in their operations, they will collect evidence and give feedback in a timely manner. The company headquarters will work with relevant departments to deal with them seriously, and reward the whistleblower.
5. Article 17 Regularly carry out training for company employees, distributors and franchisees to strengthen the awareness of the protection of minors.
Chapter Ⅵ Penalties
1. Article 18 If the sales of electronic cigarettes to minors occurs in the company’s directly-operated stores, once verified, the directly responsible person shall terminate the labor contract and investigate their leadership responsibilities.
2. Article 19 Distributors and franchisees who violate the rules of selling electronic cigarettes to minors will be warned for the first violation once verified; the second violation will be punished according to the contract; the third violation will cancel their cooperation and franchise qualifications.
Chapter Ⅶ Leading Body
1. Article 20 The company establishes a leading group to be responsible for the implementation of the protection of minors in these regulations.
2. Team leader: CEO of the company.
3. Deputy team leader: general manager of production, sales, brand and government affairs line.
4. Article 21 A secretariat shall be set up to facilitate communication with the heads of various districts and departments.
By-laws
1. Article 22 The establishment and revision of the provisions of these regulations have been approved by more than 3/4 of the company’s executive meeting and voted by the employee representative meeting.
2. Article 23 According to the Law of the People’s Republic of China on the Protection of Minors, “minors” in these regulations refer to persons under the age of 18.
